This Privacy Policy explains how we collect, use, disclose and protect personal information when you visit www.garlyfoods.com, buy from our online store, sign up for our emails or texts, enter our promotions, contact us, or otherwise interact with us online (together, the “Services”). It also explains the choices and rights you have.

1. Information we collect

Information you give us.

  • Contact and account information — name, email address, phone number, postal address, and password if you create an account.
  • Order information — shipping and billing address, items purchased, order history. Payment card information is collected directly by our payment processor; we receive only limited details such as card type, last four digits and expiration date.
  • Marketing preferences — your email and text message sign-ups, preferences and communications with us.
  • Promotion information — information you provide to enter a sweepstakes, contest or other Promotion, such as your date of birth to confirm eligibility.
  • User Content — reviews, ratings, recipes, photos and comments you submit.
  • Communications — messages you send us through contact forms, email, chat, social media or by phone.

Information collected automatically. When you use the Services, we and our service providers collect device and usage information such as IP address, browser type, device identifiers, operating system, referring URLs, pages viewed, links clicked, time spent, approximate location derived from your IP address, and whether you opened or clicked our emails. We collect this using cookies, pixels, SDKs and similar technologies, as described in our Cookie Notice.

Information from other sources. We may receive information from retail partners, social media platforms (for example, when you interact with our pages or tag us), promotion partners, analytics and advertising partners, and data providers that help us verify addresses or prevent fraud.

2. How we use information

We use personal information to:

  • process, fulfill, ship and support your orders, including sending order and shipping notifications;
  • create and manage your account;
  • respond to your questions, requests and feedback;
  • send you marketing emails and, with your express consent, text messages about products, recipes and offers;
  • run Promotions and notify winners;
  • publish reviews and other User Content you submit;
  • understand how the Services are used, and improve our products, Site and marketing;
  • personalize content and show you relevant advertising, including on other websites and platforms;
  • notify you about product recalls or safety information;
  • detect, prevent and investigate fraud, security incidents and other harmful activity; and
  • comply with legal obligations and enforce our terms.

We may also create de-identified or aggregated information that does not identify you, and use it for any lawful purpose. We will not attempt to re-identify it.

3. How we disclose information

We disclose personal information to:

  • Service providers that act on our behalf, such as website hosting, e-commerce platform, payment processing, order fulfillment and shipping carriers, email and SMS delivery, customer service, analytics, fraud prevention and IT providers. They may use personal information only to provide services to us.
  • Advertising and analytics partners that use cookies and similar technologies to help us measure and deliver advertising. See Section 5 for your choices.
  • Promotion partners — co-sponsors of a Promotion you enter, as described in its official rules.
  • Retail partners, when you ask us to share information with them or participate in a joint offer.
  • Legal and safety recipients — government authorities, courts or other parties when required by law or legal process, or when we believe disclosure is necessary to protect the rights, property or safety of GFI, our customers or others, including in connection with food safety or recalls.
  • Business transfer recipients — in connection with a merger, acquisition, financing, reorganization or sale of all or part of our business, subject to this Privacy Policy.
  • Others, with your consent or at your direction.

We do not sell personal information for money. However, allowing certain advertising partners to collect information through cookies on our Site may be considered a “sale” or “sharing” of personal information, or “targeted advertising”, under some U.S. state privacy laws. You can opt out as described in Section 5.

We never share mobile phone numbers or text-message opt-in consent with third parties for their own marketing purposes.

4. Email and text messages

You can unsubscribe from marketing emails at any time by clicking “unsubscribe” in any email or contacting us. If you sign up for text messages, you agree to receive recurring automated marketing texts at the number provided. Consent is not a condition of purchase. Message frequency varies; message and data rates may apply. Reply STOP to cancel or HELP for help. Even if you opt out of marketing, we may still send you transactional messages about your orders and account.

5. Your privacy choices

  • Cookies and targeted advertising. Use the “Cookie Settings” link in the Site footer to manage non-essential cookies, and the “Your Privacy Choices” link to opt out of the sale or sharing of personal information and targeted advertising.
  • Global Privacy Control. We recognize the Global Privacy Control (GPC) browser signal as a valid request to opt out of sales, sharing and targeted advertising for that browser.
  • Marketing. See Section 4.
  • Account information. You can review and update your account information by logging in.

6. Your state privacy rights

Depending on where you live — including California, Texas, Colorado, Connecticut, Virginia, Oregon and other states with comprehensive privacy laws — you may have the right to:

  • know / access the personal information we have collected about you, and receive a copy in a portable format;
  • correct inaccurate personal information;
  • delete personal information we have collected from you;
  • opt out of the sale or sharing of personal information, targeted advertising, and profiling in furtherance of decisions that produce legal or similarly significant effects (we do not engage in such profiling); and
  • not be discriminated against for exercising these rights.

To exercise these rights, email privacy@garlyfoods.com, call +1 (657) 272-3328, or use the “Your Privacy Choices” link. We will verify your request by matching information you provide with information we have on file. You may use an authorized agent to submit a request on your behalf; we may require proof of the agent’s authority and verify your identity directly. We will respond within the time required by law (generally 45 days).

Appeals. If we decline your request, you may appeal by emailing privacy@garlyfoods.com with the subject line “Privacy Request Appeal” within a reasonable time after receiving our decision. We will respond in writing within the time required by law. If you are not satisfied with our response, you may contact your state Attorney General.

California residents. In the last 12 months, we collected the following categories of personal information described in the California Consumer Privacy Act: identifiers; customer records; commercial information; internet or other electronic network activity information; approximate geolocation; audio or electronic information (for example, customer service call recordings, if any); and inferences drawn from the above. The sources, purposes and recipients of this information are described in Sections 1 through 3. We “sell” or “share” identifiers, commercial information, and internet activity information with advertising and analytics partners. We do not use or disclose sensitive personal information for purposes that require a right to limit. We keep each category for the period described in Section 8. Under California’s “Shine the Light” law, you may request information about disclosures of personal information to third parties for their direct marketing purposes by contacting us.

Notice of financial incentive. We may offer discounts, coupons or other benefits in exchange for signing up for our emails or texts. The terms of each offer are presented when you sign up. We believe the value of your personal information is reasonably related to the value of the offered discount, based on our good-faith estimate of the expenses related to the offer. You may withdraw from any such program at any time by unsubscribing.

7. Children’s privacy

The Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13. We do not knowingly sell or share the personal information of consumers under 16. If you believe a child has provided us with personal information, contact us at privacy@garlyfoods.com and we will delete it.

8. Data retention

We keep personal information for as long as needed for the purposes described in this Privacy Policy — for example, for as long as you have an account or remain subscribed, and afterward as needed to comply with legal, tax and accounting obligations, resolve disputes, handle product recalls, and enforce our agreements. When we no longer need it, we delete or de-identify it.

9. Security

We use reasonable administrative, technical and physical safeguards designed to protect personal information. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security. Please use a strong, unique password for your account.

10. International users and data transfers

The Services are intended for users in the United States. We and our service providers may process personal information in the United States and in other countries where we or they operate, which may have different data protection laws than where you live. We take steps to protect personal information wherever it is processed.

11. Third-party sites and social media

The Services may link to third-party websites and social media platforms. Their privacy practices are governed by their own policies, not this one. We encourage you to review them.

12. Changes to this Privacy Policy

We may update this Privacy Policy from time to time. We will post the updated version with a new “Last updated” date and, where required, notify you of material changes.
